End User License Agreement

This End User License Agreement ("Agreement") is between you ("Licensee") and Trademaster Consulting SRL, Bucharest, Romania ("Hedge4", "we", "us"), the owner of the Hedge4 software ("Software"). By downloading, installing, activating or using the Software you agree to this Agreement. If you do not agree, do not install or use the Software.
1. Licence grant
Subject to your compliance with this Agreement and payment of the applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable licence to install and use the Software for your own trading, within the limits of the licence tier you purchased (including the permitted number of computers, accounts and currency pairs shown on our pricing page).
2. Trial version
Any free trial or demo version is provided for evaluation only, is limited in features and duration, and is licensed on the same terms as this Agreement except where stated. We may modify or discontinue trial access at any time.
3. Restrictions
- You may not copy, resell, sublicense, rent, lease, distribute or otherwise make the Software available to third parties, except as expressly permitted.
- You may not reverse engineer, decompile, disassemble or attempt to derive the source code, except to the extent this restriction is prohibited by applicable law.
- You may not remove or alter any proprietary notices, or circumvent licensing, activation or usage limits.
- You may not use the Software for any unlawful purpose or in breach of any broker's or exchange's terms.
4. Ownership
The Software is licensed, not sold. All rights, title and interest in and to the Software, its documentation and any updates — including all intellectual property rights — remain with Hedge4 / Trademaster Consulting SRL. You receive only the rights expressly granted here.
5. Updates & support
We may release updates that fix bugs or improve the Software; the Software may check for and prompt you to install them. Updates and support are provided in line with your licence tier (support is available with a valid licence, up to a maximum of five years from the purchase date for the full licence). An update may include additional terms, of which you will be informed.
6. Term & termination
This Agreement applies for as long as you use the Software or your licence remains valid. We may terminate it if you materially breach it. On termination you must stop using and remove all copies of the Software. Provisions on ownership, disclaimers and liability survive termination.
7. Trading risk disclaimer
The Software is a trading tool only and does not provide investment advice or guarantee any result. Trading foreign exchange, CFDs and crypto on margin carries a high level of risk. Past performance and example results do not guarantee future outcomes. You are solely responsible for your trading decisions and may lose some or all of your capital.
8. Disclaimer of warranties
To the maximum extent permitted by law, the Software is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose. We do not warrant that the Software will be uninterrupted or error-free. Nothing in this Agreement limits any statutory rights you have as a consumer that cannot be excluded under applicable law.
9. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental or consequential damages, or for any trading losses, loss of profits or data, arising from use of or inability to use the Software. Our total aggregate liability is limited to the amount you paid for your licence. This does not exclude liability that cannot be excluded by law.
10. Governing law
This Agreement is governed by the laws of Romania and applicable European Union law. Mandatory consumer-protection rights in your country of residence remain unaffected.
